In accordance with Title 25, Chapter 70 of the Delaware Code, a monthly assessment is imposed for each rented lot in a manufactured home community. Effective January 1, 2026, the assessment is $1.50 per month for the tenant and $0 per month for the landlord.

The landlord collects the tenant’s $1.50 portion each month as additional rent. The $1.50 tenant portion is redirected to the Delaware Manufactured Homeowner Attorney Fund. The landlord remits both portions quarterly, as required by law.

DEMHRA provides relocation assistance to eligible residents when a community owner intends to change the use of all or part of the land on which the manufactured home community is located, resulting in termination or nonrenewal of the affected rental agreements, in accordance with Title 25, Chapter 70.

A change in land use occurs when a community owner intends to change the use of all or part of the land on which a manufactured home community is located and, as a result, intends to terminate or not renew affected rental agreements.

The community owner must provide affected residents with at least one year’s notice of the intended change in land use. The owner must also provide the required information and updates in accordance with Delaware law.

Depending on the circumstances and applicable eligibility requirements, you may be eligible for compensation for a nonrelocatable home or an abandonment allowance.

Required documentation may include proof that property taxes have been paid and surrender of the manufactured home title to DEMHRA. Residents should contact DEMHRA for the applicable requirements and application process.

DEMHRA may assist in the removal or disposal of an abandoned or non-relocatable manufactured home when the statutory requirements are met. If the home was abandoned outside of a qualifying change-in-land-use situation, eligibility and applicable requirements should be confirmed with DEMHRA before demolition occurs.

No. Lot rent may be increased only once during any 12 months, regardless of the term of the tenancy or rental agreement. A landlord must provide written notice of a lot rent increase at least 90 days before the effective date of the increase.

If you believe your landlord has increased the lot rent more than once within 12 months, you may file a complaint or seek assistance from the Consumer Protection Unit of the Delaware Department of Justice.

You may also contact DEMHRA for information regarding applicable manufactured-home community laws and procedures.

DEMHRA does not provide general financial assistance to residents who are unable to pay their lot rent. However, eligible homeowners may qualify for assistance through the Lot Rent Assistance Program administered by the community owner. Eligibility requirements may include receiving Social Security Disability (SSD) or Supplemental Security Income (SSI) benefits, being age 62 or older, and other statutory or program requirements.

The following eligibility criteria are identified in the current FAQ:

  • The homeowner must have owned the manufactured home and resided in the manufactured home community before July 1, 2026.
  • The homeowner must reside full-time and exclusively in the manufactured home, and it must be the homeowner’s only residence.
  • Lot rent, excluding utilities and other charges, fees, and assessments, must exceed 30% of the income of all occupants residing in the home.
  • The total liquid assets of all persons residing in the home, including bank accounts, stocks, and bonds, must not exceed $50,000.
  • The homeowner and all persons residing in the home must comply with the manufactured home community’s applicable rules, regulations, and standards.

DEMHRA does not provide direct financial assistance for emergency repairs to manufactured homes. However, eligible homeowners may be able to obtain assistance through the Statewide Emergency Repair Program (SERP), which assists eligible homeowners of manufactured homes located in land-leased communities with certain emergency repairs.

SERP is administered by the Milford Housing Development Corporation on behalf of the Delaware State Housing Authority. Residents may call (844) 413-0038 to determine whether they may qualify. Additional information may also be available through the Delaware Manufactured Homeowners Association (DMHOA).

Examples of qualifying emergencies may include:

  • Heating system repairs during the winter months
  • Non-functioning plumbing
  • Hazardous electrical conditions
  • Roof repair or replacement for active leaks
  • Major structural repairs
  • Urgent accessibility modifications
